SALES AND REFUND TERMS OF USE (‘TERMS’)

IMPORTANT: PLEASE, READ THESE TERMS CAREFULLY, SINCE YOUR USE OF ANY OF THE SERVICES CONSTITUTES ACCEPTANCE OF THESE TERMS AND CREATES A BINDING LEGAL AGREEMENT. YOU MUST ACCEPT THESE TERMS IF YOU WISH TO USE ANY OF THE SERVICES. IF YOU CHOOSE TO ACCEPT THESE TERMS, YOU MUST DO SO AS THEY ARE PRESENTED TO YOU; NO CHANGES (ADDITIONS OR DELETIONS) WILL BE ACCEPTED BY SECURE SWISS DATA.

Introduction

By using this site and making use of Secure Swiss Data, a service offered by us, you agree to abide by the following Terms and Conditions for use. These Terms and Conditions cover all present and future features offered by your Secure Swiss Data account, individually and collectively referred to as the “Service”.
By placing an order or making a purchase of Secure Swiss Data services, you agree to the terms set forth below along with Secure Swiss Data’s Privacy Policy and Terms of Use.

Secure Swiss Data may change, add or remove any part of these Terms at any time. If it does so, Secure Swiss Data will post such changes on https://secureswissdata.com/sales-and-refunds-terms-of-use/

Users of the Service

To use any of the Services, you must be at least 16 years old. If you are under the required age, you may still use the Services, but only if the account you are using was created and registered by your parent or legal guardian. Each user is solely responsible for all of his or her messages sent through the Service.

Use of the Service

There are rules and standards that you must abide by in connection with your use of the Service. As a user of the Service, you acknowledge that Secure Swiss Data has the right to enforce these rules as it deems appropriate at its sole discretion. This means that if you, or anyone using your account or identifying information, violate these Terms, Secure Swiss Data may take any and all actions – from the issuance of a warning to terminating your right to use the Service and to cancellation of your order or account for any Products and involvement of the appropriate authorities – that Secure Swiss Data deems necessary or appropriate.

By using this Service, you agree to not use this Service for any unlawful or prohibited activities. You also agree to not disrupt or attempt to disrupt in any way the Secure Swiss Data networks and servers. You further agree to not use Secure Swiss Data to send spam or junk mail, or mailing list emails that contain persons that have not specifically agreed to be included on that list.

For the purpose of these Terms and Conditions, spam shall refer to irrelevant or unsolicited messages sent over the Internet, typically to large numbers of users, for the purposes of advertising, phishing, spreading malware or virus (“Spam”). Secure Swiss Data also does not support bulk email sending.

Any account found to be generating Spam will be immediately suspended and/or terminated. We may also terminate accounts which are being used for illegal activity, in particular in response to court orders from the competent authorities informing us of such illegal activity.

Availability of the Service

While Secure Swiss Data will make all reasonable efforts to ensure that the Service is available at all times, Secure Swiss Data does not guarantee, represent or warrant that your access to the Service will be uninterrupted or error-free.

Limited Warranties and Liability

Secure Swiss Data does not make any warranty about the reliability of the Service. The Service is provided “as is” and you agree to not hold Secure Swiss Data responsible nor to seek indemnification for any damages that may arise as a result of the loss of use, data, or profits connected to the performance of the Service or failure in such performance.

Indemnification

You agree that Secure Swiss Data, and any parents, subsidiaries, officers, employees, or third party contractors cannot be held responsible for any third party claim, demand, or damages, including reasonable attorneys’ fees, arising out of your use of this Service.

Subscription Terms and Renewals

The Service is provided on a subscription basis for a set term specified in your Order (“Subscription Term”). The duration of the subscription is 12 months. After the subscription has been created it cannot be cancelled during its set term. By creating a subscription you undertake to pay its full cost.

During the term of the subscription you can:

  1. Delete the user of a particular seat and assign another user to it, but the seat itself cannot be deleted.
  2. Add storage to lite seats only. The prices are indicated on our website per month. Please, note the following:
  • you can buy as much additional storage as you wish;
  • by adding storage to your lite product you undertake to pay for it until the subscription for your current product ends;
  • you can upgrade the amount of your additional storage (e.g. from 10 GB to 50/100GB; or from 50GB to 100GB) BUT you cannot downgrade it (e.g. from 100 GB to 10 GB).
  1. You can buy new seats both in lite and full products, and create new users for them or move users from existing seats such as from lite to full.
  2. Cancel a subscription in advance by clicking the “cancel” button in your admin account settings or choosing such an option when receiving a reminder letter before the expiring date of the subscription.

All subscriptions will automatically renew for a period of 12 months (and you will be charged at the then-current rates) unless you cancel your subscription through your account. If you cancel, your subscription will terminate at the end of its term. Please, note that you will not be entitled to any credits or refunds prior to the end of your subscription term.

Account Registration 

You need to register for a Secure Swiss Data account in order to place orders or access or receive the Service. Any registration information that you provide to us must be accurate, true, current and complete. You must also update your information so that we may send notices, statements and other information to you by your registration email or through your account. You are responsible for all actions taken through your accounts.

Credentials

You must ensure that all authorised users keep their user IDs and passwords strictly confidential and not share such information with any unauthorised person. User IDs are granted to individual, named persons and may not be shared. You are responsible for any and all actions taken using your accounts and passwords, and you agree to immediately notify Secure Swiss Data of any unauthorised use of which you become aware.

Data Retention after the End of Subscription Term

Secure Swiss Data has no obligation to store or forward the contents of terminated accounts. We also have no obligations to store messages for accounts that are over their storage quotas. We may remove or delete your data within a reasonable period of time after the termination of your Subscription Term. Due to the encrypted nature of Secure Swiss Data, you acknowledge that Secure Swiss Data has no ability or obligation to recover your data if you misplace your decryption password.

Pricing and Price Reductions/Corrections

Secure Swiss Data reserves the right to change prices for products displayed at www.secureswissdata.com/pricing at any time.

Prices shown at our website are in CHF. If you are paying for your order with an international Visa, MasterCard, or American Express credit card, please, note that the purchase price may fluctuate with exchange rates. In addition, your bank or credit card issuer may also charge you foreign conversion charges and fees, which may also increase the overall cost of your purchase. Please, contact your bank or credit card issuer regarding these fees.

Storage and unlimited storage is subject to conditions and may vary from time to time.

Payment 

You can choose the frequency of payment for your subscription:

  • make one-off payment for the whole period of 12 months – yearly payment;
  • pay half-yearly;
  • pay quarterly;
  • pay monthly.

You authorise Secure Swiss Data to charge any credit card supplied on a monthly/quarterly/half-yearly/yearly re-occurring basis. You are responsible for keeping your card information up to date. Paid accounts that become delinquent may be suspended or eventually deleted after an extended period of delinquency.

In case of non-payment your account will be blocked within a month unless you renew the payment method. We reserve the right to address non-payments to a debt collection agency in case you ignore your payment obligations. We are as well entitled to discontinue service immediately if a fraudulent payment is detected, such as the use of a stolen credit card, and such cases may be further referred to the competent authorities.

Due to their nature, the paid Services provided by Secure Swiss Data are non-refundable and any credits given will be at the sole discretion of Secure Swiss Data.

Paid accounts which are terminated due to a violation of these Terms and Conditions will incur the loss of all payments and are not eligible for refund.

If Secure Swiss Data chooses to issue a refund for any reason, Secure Swiss Data is only obligated to refund in the original currency of payment and payment method. 

Modifications to Terms of Service

Within the limits of applicable law, Secure Swiss Data reserves the right to review and change this agreement at any time. You are responsible for regularly reviewing these Terms and Conditions. Continued use of the Service after such changes shall constitute your consent to such changes. We may make improvements and changes to the Service at any time without notice. Secure Swiss Data may at its sole discretion, terminate service without cause or notice. Although it is not the current practice now, we reserve the right to suspend or delete accounts that are inactive for over 12 months.

Applicable Law

This Agreement shall be governed in all respects by the substantive laws of Switzerland. Any controversy, claim, or dispute arising out of or relating to the Agreement shall be subject to the jurisdiction of the competent courts of the Canton of Zurich, the jurisdiction of the Swiss Federal Court being expressly reserved.
